1. Prior to approval of a final subdivision plat, or issuance of a certificate of occupancy for a multi-family or non-residential development project, a maintenance warranty in a form of surety as described in this Section is required for all stormwater detention facilities and for all street and stormwater drainage improvements shown on the record “as-built” surveys, and for all landscaping specifically required by this Development Code. 2. The provision of such surety shall not limit the owner’s responsibility for the full cost of maintenance, repair or restoration during the maintenance period of all improvements required by this Development Code and included in the pertinent Development Performance and Maintenance Agreement.
