Street Rights-of-Way

**Governing jurisdiction: Duluth.** A "Duluth, GA" mailing address is usually NOT in the City of Duluth. Unincorporated Gwinnett is 67.3% of the county's land area and is governed by a different code, a different board and a different permit portal. Resolve the governing jurisdiction before answering any zoning question.

1. The minimum width of rights-of-way shall be dedicated based upon the street classification as shown in
the Comprehensive Plan or on the Planning and Development Department web page and as contained in
this Article.

2. Additional street right-of-way width may be required to be dedicated at intersections or other locations
fronting the property where turning lanes, storage lanes, medians or realignments are required for traffic
safety and minimum right-of-way standards would be inadequate to accommodate the improvements.
3. If a new street or thoroughfare is proposed by the Comprehensive Plan, Gwinnett County or the State of
Georgia to adjoin or traverse the property, permits shall not be issued until the Planning and
Development Department has submitted the project to the City Council for review in order to seek a
determination if the City of Duluth should acquire right-of-way or if a study of alternate routes should be
undertaken. The review period by the City of Duluth shall not exceed 90 days from the date of permit
application.
