Penalties

**Governing jurisdiction: Duluth.** A "Duluth, GA" mailing address is usually NOT in the City of Duluth. Unincorporated Gwinnett is 67.3% of the county's land area and is governed by a different code, a different board and a different permit portal. Resolve the governing jurisdiction before answering any zoning question.

## Text

1. When a building or other structure has been constructed in violation of this section, the violator may be
required to remove the structure at the discretion of the Director of the Planning and Development
Department.
2. When removal of vegetative cover, excavation, or fill has taken place in violation of this section, the
violator may be required to restore the affected land to its original contours and to restore vegetation, as
far as practicable, at the discretion of the Director of the Planning and Development Department.
3. If the Director of the Planning and Development Department discovers a violation of this Code Division
that also constitutes a violation of any provision of the Clean Water Act as amended, the City Council shall
issue written notification of the violation to the U.S. Environmental Protection Agency, the U.S. Army
Corps of Engineers, and the landowner.
