# Duluth UDC § 802.01

Grandfather Provisions

**Governing jurisdiction: Duluth.** A "Duluth, GA" mailing address is usually NOT in the City of Duluth. Unincorporated Gwinnett is 67.3% of the county's land area and is governed by a different code, a different board and a different permit portal. Resolve the governing jurisdiction before answering any zoning question.

## Text

Division I of this Article shall not apply to the following activities, when such activities were lawfully established
prior to the effective date of this Code Division or its predecessor ordinance:

1. Work consisting of the repair, maintenance or replacement within the same disturbed area of any lawful
use of land that is zoned and approved for such use.
2. Existing development and ongoing land disturbance activities including but not limited to existing
agriculture, silviculture, landscaping, gardening and lawn maintenance, except that new development or
land disturbance activities on such properties will be subject to all applicable buffer requirements.
3. Any lawful land development activity that was under construction, has a valid permit, or has submitted a
valid and complete application for a permit.
4. Any lawful land development activity that has not been submitted for approval, but that is part of a
Planned Development that has been conceptually approved.
