# Duluth UDC § 711

Exemptions

**Governing jurisdiction: Duluth.** A "Duluth, GA" mailing address is usually NOT in the City of Duluth. Unincorporated Gwinnett is 67.3% of the county's land area and is governed by a different code, a different board and a different permit portal. Resolve the governing jurisdiction before answering any zoning question.

## Text

The following shall be exempt from the provisions of this Code Division:

a. The removal of trees from a developed residentially zoned, single-family lot of one acre or less.
b. The necessary removal of trees by a utility company within dedicated utility easements provided

alternative methods to trenching are used when possible, including boring and tunneling.
c.
The removal of trees on public rights-of-way conducted by, on behalf of, or any activity pursuant to work
to be dedicated to, a federal, state, county, municipal or other governmental agency in pursuance of its
lawful activities or functions in the construction or improvement of public right-of-way.
d. The removal of trees from lakes, and detention ponds and drainage easements provided they are not

within a stream buffer.
e. The removal of any tree which has become or threatened to become a danger to human life or property

or the removal of a diseased or infested tree to prevent the transmission of disease or infestation. The
owner/developer, prior to removal of the diseased tree(s), shall provide a report from a professional
arborist to the Planning and Development Director prior to tree removal. This report shall identify the
conditions of the tree(s) that necessitate removal. In the case of immediate danger to life and property
the tree may be taken down and an inspection requested to verify the condition of the tree.
f.
Notwithstanding the foregoing, all reasonable efforts shall be made to save Specimen Trees as defined in
Article 14.
