Special Exceptions

**Governing jurisdiction: Duluth.** A "Duluth, GA" mailing address is usually NOT in the City of Duluth. Unincorporated Gwinnett is 67.3% of the county's land area and is governed by a different code, a different board and a different permit portal. Resolve the governing jurisdiction before answering any zoning question.

## Text

a. The Planning and Development Director has the authority to administratively grant a Special Exception

under the Appeals Article of this Development Code if the applicant can provide a reasonable case and
will not vary from the regulations herein by more than 10%, except for the number of days a temporary
sign is allowed.
b. The Planning and Development Director may grant variance Special Exception for the number of signs per

storefront or building façade provided the organization of the signs or sign components is consistent with
this Article, provides a balanced appearance on the building or similar circumstance, provided the overall
allowable square footage has not been exceeded.
