# Duluth UDC § 602.02

Signs that are Exempt from Permitting Requirements

**Governing jurisdiction: Duluth.** A "Duluth, GA" mailing address is usually NOT in the City of Duluth. Unincorporated Gwinnett is 67.3% of the county's land area and is governed by a different code, a different board and a different permit portal. Resolve the governing jurisdiction before answering any zoning question.

The following signs are exempt from the permitting requirements of this Article; provided, however, that all such
signs must meet the setback requirements of this Article and shall not be located within any public right-of-way or
within any Visibility Clearance Area set forth in Section 603.08.

a. Property address numbers as required by the City are exempt.
b. Incidental signs (as defined in this Development Code) that are located in conjunction with a multi-family

or nonresidential use are exempt, provided such signs are not illuminated and that the aggregate of all
such signs on a property may not exceed 9 square feet (unless a larger aggregate area is required by law
or government regulation).
c.
Displays or decorations related to a holiday or seasonal event (as defined in this Development Code) that
are placed on a property by the owner or with the owner’s permission are exempt.
d. Signs located on property advertising the property being for sale or lease with a total maximum area of

sixteen (16) square feet per lot and a maximum height of four (4) feet per sign.
e. Window displays of goods available on a site are not considered to be signs and are exempt from these

sign regulations.
f.
 A building design or color that is associated with a particular establishment or organization, but which
conveys no message is not considered to be a sign and is exempt from these sign regulations.
