# Duluth UDC § 340.01

General Requirements for Temporary Events, not Including Yard Sales

**Governing jurisdiction: Duluth.** A "Duluth, GA" mailing address is usually NOT in the City of Duluth. Unincorporated Gwinnett is 67.3% of the county's land area and is governed by a different code, a different board and a different permit portal. Resolve the governing jurisdiction before answering any zoning question.

1. A temporary use permit shall be applied for and approved by the Department of Planning and
Development. Written permission of the property owner shall be provided with the application.

Article Three. Restrictions on Particular Uses

2. The temporary use may be permitted for a period not to exceed 20 days unless specifically
provided for with the use, and with the exception that one 10-day extension may be granted by
the Planning and Development Director for uses in the C-1 and HC Districts.
3. A permit for any temporary use on the same property may not be applied for or renewed for a
period of not less than 30 days from the date of any prior approval of a temporary use.
4. Each non-residential property can apply for a temporary event no more than once per quarter
(per calendar year beginning in January and ending in December)
b. Location. The temporary use shall not be located within 20 feet of the public right-of-way or within 30

feet of any intersection of two or more public rights-of-way.

Parking. Adequate parking ingress and egress shall be provided onsite, or on an adjacent site with written
permission of the property owner.
