Exceptions

**Governing jurisdiction: Duluth.** A "Duluth, GA" mailing address is usually NOT in the City of Duluth. Unincorporated Gwinnett is 67.3% of the county's land area and is governed by a different code, a different board and a different permit portal. Resolve the governing jurisdiction before answering any zoning question.

1. Exceptions to Front Yard Requirements.
a. Any lot where the average depth of the front yards of existing buildings on adjoining lots (which

are located wholly or in part within 100 feet on each side of such lot, and are within the same
block and zoning district and fronting on the same side of the street) is either greater or less than
the minimum required front yard depth shall meet the following requirements:

i. If the average depth of the adjacent front yards is greater than the required minimum

front yard depth, the depth of the front yard of such proposed lot shall be the average
of the adjacent front yards of the above-mentioned buildings but need not be greater
than 150% of the required front yard depths.
ii. If the average depth of the adjacent front yards is less than the required minimum front

yard depth, the depth of the proposed front yard of such lot may be less than the
required front yard depth but shall not be less than the average of the adjacent front
yards of the aforementioned buildings.
2. Exceptions to Height Limitations.
a. The height limitations of this Development Code shall not apply to the following structures nor

architectural features: church spires, belfries, flag poles, monuments, cupolas, domes,
ornamental towers, observation towers not intended for human occupancy, water towers,
transmission towers, radio or television towers or aerials, chimneys, smokestacks, conveyors,
derricks, parapet walls extending not more than 4 feet above the roof line of the building,
necessary mechanical roof appurtenances or barns and silos when located on a farm.
