Violation and Penalties

**Governing jurisdiction: Duluth.** A "Duluth, GA" mailing address is usually NOT in the City of Duluth. Unincorporated Gwinnett is 67.3% of the county's land area and is governed by a different code, a different board and a different permit portal. Resolve the governing jurisdiction before answering any zoning question.

1307.01. Violations
Any action or inaction which violates the provisions of this Development Code or any permit issued thereunder,
may be subject to the enforcement actions outlined in this Section. Any such action or inaction which is continuous
with respect to time is deemed to be a public nuisance and may be abated by injunctive or other equitable relief,
as described under Section 1307.06(1). The undertaking of any administrative enforcement action or the
imposition of any of the penalties described below shall not prevent such equitable relief.
