Application and Initial Actions

**Governing jurisdiction: Duluth.** A "Duluth, GA" mailing address is usually NOT in the City of Duluth. Unincorporated Gwinnett is 67.3% of the county's land area and is governed by a different code, a different board and a different permit portal. Resolve the governing jurisdiction before answering any zoning question.

## Text

1. An application for a special exception, hardship or floodplain management variance shall include such
descriptions, maps or drawings as needed to clearly illustrate or explain the action requested, and such
filing fees as may be required. The Planning and Development Director may request such additional
information from the appellant as necessary to provide a full understanding of the appellant’s request.
2. Once the record has been assembled, the Planning and Development Director will:
a. Schedule unresolved appeals for consideration at the next meeting of the Zoning Board of

Appeals for which adequate public notice can be given; and
b. Send a letter by first class mail to the appellant or his attorney notifying the appellant of either 1)

administrative resolution of the matter or 2) the date, time, and place of the public hearing.
