# Duluth UDC § 1203.03

Standards for Approval

**Governing jurisdiction: Duluth.** A "Duluth, GA" mailing address is usually NOT in the City of Duluth. Unincorporated Gwinnett is 67.3% of the county's land area and is governed by a different code, a different board and a different permit portal. Resolve the governing jurisdiction before answering any zoning question.

## Text

A special exception may be approved upon a finding that the relief, if granted:

1. Would not cause substantial detriment to the public good; and
2. Would comply with all fire safety, utility and environmental health code requirements; and
3. Would not be injurious to the use and enjoyment of the environment or of other property in the
immediate vicinity; and
4. Would not diminish and impair property values within the surrounding neighborhood; and
5. Would not impair the purpose and intent of this Development Code.
